Appendix E: Good Samaritan Clinic Notice of Privacy Practices
The Good Samaritan Clinic’s most basic desire is to provide free medical and/or dental care to our patients. To achieve our goal and also respond to agencies who provide funding to GSC, we use this Notice of Privacy Practices to let you know how we share the minimum amount of information to funders but also protect your confidential health information. Please read it carefully.
Understanding Your Health Records and Information
A record is created each time you receive services from our medical or dental professionals at the Clinic. This record contains your reason for visit, diagnoses, treatment, and a plan for future care or treatment. With your permission, we will confidentially communicate some details about your care with other licensed health professionals who contribute to your care. Your medical record can be a resource for medical investigators, public health initiatives, and facility planning. The purpose of this Notice of Privacy Practices is to help you understand what is in your medical record and who, what, when, where, and why others can have access to your health information.
Your Rights and Your Health Information
Even though your health record is the physical property of the healthcare practitioner or of the facility that compiles it, the information belongs to you. You have rights laid out in the Health Insurance Portability and Accountability Act (HIPAA) of 1996, and federal regulation (42 CFR Part 164). These rights include:
· The right to request the Clinic restricts certain uses and divulgences of your health information.
· The right to review and obtain a copy of your medical record.
· The right to amend or correct your medical record. However, the Clinic is not required to agree with the solicited amendments under certain circumstances.
· The right to obtain a list of who has seen your health information.
· The right to ask the Clinic to communicate your health information through your mobile phone, email or other form you designate.
Our Responsibilities
The Good Samaritan Clinic will:
· Protect the privacy of patients’ health information.
· Provide the patient with a Notice of Privacy Practices describing the obligations and legal practices with respect to the information the Clinic collects and saves in regard to the patient.
· Notify the patient if your protected health information is improperly disclosed;
· Comply with the terms laid out in the Notice of Privacy Practices.
· Notify the patient if the Clinic cannot agree to a requested restriction.
· Satisfy reasonable requests the patient can make in order to communicate health information through alternative manners or locations.
The Good Samaritan Clinic reserves the right to make minor changes to this Notice of Privacy Practices without informing you. However, we will post this Notice and any changes on our website.
The Clinic can use and divulge your health information for purposes of Treatment and Healthcare Operations.
Treatment: At each visit, your clinal team will document in your record the expectations he or she has for you and also for other members of their healthcare team. In the event your clinician wants you to see a specialist, we can share basic details about your care with the specialist.
Payment: GSC is a free clinic. We do not submit information about you to payers for reimbursement. However, we may provide general de-identified information about our patient populations to grantors.
Healthcare Operations: GSC can share your de-identified health information with our business partners. Members of the Clinic’s medical personnel, as well as staff that focus on risk control and improvement of quality can use your health information to evaluate the care you’ve received and results you’ve seen, and to contrast it with other similar records. This information then will be used in a continuous effort to better the quality and the effectiveness of healthcare and the services we provide.
Other permitted or required divulgences and uses of healthcare information
Communication with Family: Using our best judgment, and with your permission, our healthcare professionals may divulge information to a member of the patient’s family.
Government Functions: The patient’s health information can be divulged to protect public officials, national security, nutritional or drug safety, and other specialized government functions, as necessary.
Notification: If you are present and invite a family member into the exam room with you, we will ask if it’s okay to verbally share protected health information with them. If you are incapacitated, or in an emergency situation, information directly related to notification or your treatment can be divulged without your agreement if it is determined by a health care provider to be in your best interests.
Follow-up after Treatment: The Clinic can communicate with the patient to verify their state of health or to ensure that the Clinic has answered all questions the patient has. If the patient participates in support groups after their treatment, the Clinic can give tools to the patient at their convenience so that they can inform others of their diagnosis and/or treatment.
Public Health: As the federal and state laws require, the Clinic can divulge the patient’s healthcare information to public health or legal authorities charged with preventing, reporting, and controlling sicknesses, lesions, disabilities, other activities, or health vigilance.
Required by Law or Law Enforcement: The Clinic can use and divulge information about the patient as is required by law.
Other uses and divulgences of the patient’s health information will be conducted solely with the written authorization of the patient. The patient can revoke their authorization to use or divulge their health information at any time except when the action has already been taken.

Esta información, frecuentemente referido como su récord médico o récord de salud, es un documento legal que describe el cuidado que usted recibió, y sirve como una base para planear su cuidado o tratamiento. Es comunicado entre los profesionales de salud que contribuyen a su cuidado. Su récord médico puede ser un recurso de datos para investigaciones médicas, iniciativas de salud pública y plan de facilidad. El propósito de este Aviso de Practicas de Privacidad es el de ayudarle a entender lo que hay en su récord médico y quien, que, cuando, donde y por qué otros puedan tener acceso a su información de salud.
Sus Derechos y Su Información de Salud
Aunque su récord de salud es propiedad física del practicante médico o de la facilidad que lo recopila, la información le pertenece a usted. Usted tiene derechos proporcionados por el Acta de Traspaso y Responsabilidad del Seguro Médico de 1996 (HIPAA, por sus siglas en ingles), una regulación federal (42 CFR Parte 164). • El derecho a reseñar y obtener una copia de su récord médico.
• El derecho a enmendar o corregir su récord médico. Sin embargo, la clínica El Buen Samaritano no se le requiere estar en acuerdo con las enmiendas solicitadas bajo ciertas circunstancias
• El derecho a obtener un listado de ciertas divulgaciones de su información de salud.
• El derecho a solicitar comunicación de su información de salud a través de maneras o lugares alternos.
Nuestras Responsabilidades
A la clínica El Buen Samaritano se le requiere:
• conservar la privacidad de su información de salud.
• proveerle con un Aviso de Prácticas de Privacidad describiendo sus obligaciones y prácticas legales con respecto a la información que nosotros recolectamos y conservamos sobre usted.
• notificarle si su información de salud esta divulgada indebidamente.
• cumplir con los términos del Aviso de Prácticas de Privacidad.
• notificarle si nosotros no podemos acordar con una restricción solicitada.
• satisfacer solicitudes razonables que usted pueda tener para comunicar la información de salud a través de diferentes maneras o lugares.
La clínica El Buen Samaritano reserva el derecho a cambiar nuestras prácticas de privacidad sin informarle. La versión más reciente de nuestro Aviso de Practicas de Privacidad estará publicada en nuestra página web y en cada una de nuestras clínicas.
Nosotros podemos usar y divulgar su información de salud para propósitos de Tratamiento y Operaciones de Cuidado de Salud.
Tratamiento: En Cada visita médica nuestro equipo de cuidado de salud obtendrá información de su salud que será documentado en su récord médico y será utilizada para determinar el curso de su tratamiento. En el caso que usted sea referido a un especialista esta información de salud documentada puede ser compartida con el especialista.
Pago: La Clínica el Buen Samaritano es una clínica gratuita. No enviamos información suya a ningún lugar para obtener pago o reembolso. Sin embargo, podemos proporcionar información general no identificada sobre nuestras poblaciones de pacientes a las organizaciones de dan fondos a la clínica cuando esta sea requerida.
Operaciones de Cuidado de Salud: Miembros del personal médico, los equipos de control de riesgo y mejoramiento de calidad pueden usar su información de salud para evaluar el cuidado y los resultados en su caso y compararlo con otros casos similares. Otras Divulgaciones y Usos de su Información de Salud Permitidos o Requeridos

Funciones Gubernamentales: Su información de salud puede ser divulgada con el propósito de proteger oficiales públicos, seguridad nacional y actividades de espionaje y otras funciones gubernamentales especializadas, como sea necesario.
Notificación: Si usted está con su doctor, y hay familiares suyos presentes, su proveedor le preguntará a usted si está bien compartir su información de salud con ellos y usted deberá dar su consentimiento. Si usted está ausente, está incapacitado, o en una situación de emergencia, su doctor puede dar información de salud o tratamiento sin su consentimiento a sus familiares, siempre que sea para su beneficio.
Seguimiento Después del Tratamiento: La Clínica puede comunicarse con usted para verificar su estado de salud o para asegurarse de que hemos contestado todas sus preguntas. Si usted participa en grupos de apoyo después del tratamiento, La Clínica puede dar más información al paciente para que este pueda informar a otros sobre su diagnóstico y tratamiento
Salud Publica: Tal y como lo requiere la ley federal, estatal y local, nosotros podemos divulgar su información de salud a las autoridades de salud pública o legales encargadas de prevenir, reportar y controlar enfermedades, lesiones, incapacidad, o para otras actividades de vigilancia de salud.
Requerido por la Ley o Ejecución de la Ley: La Clínica El Buen Samaritano puede usar y divulgar información sobre usted como lo requiera la ley.
Otros usos y divulgaciones de su información de salud serán hechos solamente con su autorización por escrito. Usted puede revocar su autorización a usar y divulgar información de salud en cualquier momento excepto cuando esa acción ya ha sido tomada.
